Bastion Safety Solutions — Course Terms of Service
Version 1.0 · Effective June 26, 2026
These Terms govern access to and completion of any online training course offered by Bastion Safety Solutions Inc. (“Bastion,” “we,” “us”), each, a “Course.” By enrolling in, purchasing, or accessing a Course, or by accepting these Terms at enrollment, you (the “Learner,” or the organization purchasing on behalf of its workers) agree to these Terms. If you do not agree, do not access the Course. Each Course is delivered through an online learning platform (the “Platform”), which may be operated by Bastion or by an authorized third-party provider, depending on where you purchased or accessed the Course.
1. What our Courses are — and are not
- Completion of a Course, including passing its assessment, confirms that the Learner has completed the training and demonstrated understanding of the theoretical content presented, by achieving the required assessment score, as of the completion date.
- Competency in the workplace means being adequately qualified, suitably trained, and of sufficient experience for a specific task. A Course provides the training component only. It does not establish that a Learner is qualified, or of sufficient experience, for any specific task, equipment, or site.
- Under the occupational health and safety legislation that applies to your workplace, the employer or a qualified supervisor, not a training provider, determines competency, based on the actual task, equipment, and site conditions.
- A Course is not a substitute for the applicable standard(s) or legislation, your employer’s health and safety program, site-specific procedures, hazard assessments, or hands-on supervised qualification.
- The Learner, and any employer relying on a Course, are responsible for exercising their own judgment and for verifying that any action taken is appropriate to the actual task, equipment, and site conditions. A Course is one input and must not be relied on as the sole basis for any safety-critical decision.
2. Standards, editions, and currency
- Where a Course is based on a published standard, code, or external requirement, that standard/edition is identified in the Course’s description and forms part of these Terms… (current as of publication)
- Standards and laws change. Courses are not automatically updated when a standard, code, or law changes. You are responsible for confirming you are relying on current requirements.
- Bastion does not warrant that completing a Course makes you, your workers, or your organization compliant with any law, regulation, standard, or third-party requirement.
3. Acceptance and records
- You accept these Terms when you enroll in, purchase, or access a Course, or when you accept them at enrollment on the Platform.
- Where a Course is purchased by an organization for its workers, the organization accepts these Terms on its own behalf and on behalf of each worker it enrolls.
- Acceptance and completion records are maintained by the Platform through which you access the Course.
4. Limitation of liability
- To the maximum extent permitted by law, Bastion’s total liability for any financial or economic loss arising out of or relating to a Course is limited to the amount actually received and retained by Bastion for the Course seat giving rise to the claim.
- Bastion is not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profit, production, or opportunity.
- Except as expressly stated in these Terms, each Course is provided “as is” and “as available,” and Bastion disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and the accuracy or completeness of content, to the maximum extent permitted by law.
- Bastion’s limitation of liability in this Section applies in addition to, and does not reduce, the indemnity obligations of an Organizational Purchaser under Section 10.
- Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud, or for death or personal injury to the extent caused by Bastion’s negligence.
5. Delivery, payment, and refunds
- Each Course is delivered through the Platform on which you access it. The Platform may be operated by Bastion or by an authorized third-party provider.
- Access, completion records, certificates, payment processing, and refunds are provided by that Platform under the Platform’s own terms.
- Refund eligibility is governed by the Platform through which you purchased the Course. Where a Course is sold through a third-party Platform, Bastion does not process payments or refunds, and is not responsible for that Platform’s billing, availability, acts, or omissions.
6. Intellectual property
- The Courses and all their content are owned by Bastion. You receive a limited, personal, non-transferable right to access and complete a Course you have purchased or been enrolled in. You may not copy, record, redistribute, resell, or create derivative works without Bastion’s written permission.
7. Certificates and validity
- A completion certificate reflects completion of the relevant Course as of its issue date. Any recommended retraining interval is stated in that Course’s description.
8. Changes to these Terms
- We may update these Terms. Each version carries a version number and Effective Date. The version in effect when you accepted governs your completion — later changes do not apply retroactively to a Course you have already completed.
9. Governing law
- These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, and the courts of Alberta have exclusive jurisdiction. The Courses are intended for use in Canada.
10. Indemnity by Organizational Purchasers.
- Where an organization purchases or provides access to a Course for its workers or others (an “Organizational Purchaser”), that Organizational Purchaser will indemnify, defend, and hold harmless Bastion Safety Solutions Inc. and its directors, officers, and employees from and against any third-party claim, demand, action, loss, or expense (including reasonable legal fees) arising from or relating to: (a) the Organizational Purchaser’s determination of worker competency or qualification; (b) its assignment of any worker to a task, or its reliance on Course completion as a measure of fitness for a task; or (c) its acts or omissions in deploying, supervising, or applying the training.
- Bastion will give the Organizational Purchaser prompt written notice of any claim subject to this indemnity. The Organizational Purchaser will control the defense and settlement of the claim using counsel of reasonable choice, provided that it will not settle any claim in a way that imposes a non-indemnified obligation on Bastion without Bastion’s consent. Bastion may participate in the defense with its own counsel at its own expense.
- This indemnity does not apply to the extent a claim is caused by Bastion’s own gross negligence or willful misconduct.
11. Severability
- If any provision of these Terms is found invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
12. Force Majeure
- Bastion is not liable for any delay or failure to perform, including the unavailability of a Course or Platform, caused by events beyond its reasonable control, including natural disasters, fire, flood, power or internet failures, Platform or third-party provider outages, labour disruptions, pandemics, or government action.
13. No waiver
- Bastion’s failure to enforce any provision of these Terms is not a waiver of that provision, or of its right to enforce that provision or any other provision later.
